How to write a lease termination letter in 3 steps

  1. Choose the kind of letter

A landlord ending a month-to-month tenancy, an early termination agreement both sides sign, a tenant asking to end the lease early, or a servicemember ending a lease under the Servicemembers Civil Relief Act.

  2. Fill in the dates and details

The end date and the move-out date, the people and the rental, and for an agreement the rent paid through and any termination fee. The wording follows the kind of letter; rewrite any of it.

  3. Sign, send and keep a copy

Sign on the pad or in ink, deliver it in a way you can prove, and fill in the record of delivery on your copy.

Which letter do you need?

  • Landlord ending a month-to-month tenancy: a written notice with the date the tenancy ends. The notice period is set by the law where the rental is (often 30 or 60 days).
  • Early termination by agreement: landlord and tenant agree to end a fixed-term lease early, with the date, the rent paid through, any fee and what happens to the deposit, and both sign.
  • Tenant asking to end the lease early: a polite request, with the date you would like and the reason. The landlord does not have to agree unless the lease or the law says so.
  • Military orders (SCRA): a servicemember’s notice ending a residential lease under federal law, with a copy of the orders.
  • Not renewing a fixed-term lease? Use the lease non-renewal notice. A tenant moving out of a month-to-month rental? Use the notice to vacate.

What a lease termination letter should include

  • The date of the letter, the names of the landlord and the tenant, and the address of the rental
  • The date the tenancy or lease ends, and the move-out date if different
  • For an agreement: the rent paid through, any termination fee, what happens to the deposit, and both signatures
  • Requests that help at move-out: keys, a forwarding address, the move-out inspection
  • A signature, and a record of how and when the letter was delivered

Military orders: the Servicemembers Civil Relief Act

Under the Servicemembers Civil Relief Act, a servicemember can end a residential lease signed before entering military service, or signed while in service and then receiving orders for a permanent change of station or a deployment of at least 90 days (50 U.S.C. § 3955).

The lease is ended by giving the landlord written notice and a copy of the military orders, by hand, by private business carrier, by mail with return receipt requested, or electronically.

For a lease with monthly rent, the termination takes effect 30 days after the first date the next rent is due after the notice is delivered. The landlord may not charge an early termination fee; rent for the time before that date is paid on a prorated basis, and rent paid in advance for the time after it is refunded within 30 days.

Ending a lease in Canada, the UK and Australia

Tenancy law is set by each province, nation or state. These are plain-English summaries of the official text, read again on the date shown.

Canada · checked

  • Ontario: A landlord and tenant can agree to end a tenancy with no notice, but an agreement or tenant’s notice signed when the lease was made, or as a condition of it, is void. A tenant’s own notice is at least 60 days for a monthly tenancy. RTA ss. 37, 44
  • British Columbia: Landlord and tenant can end a tenancy by agreeing in writing. A tenant’s notice gives at least one month and cannot end a fixed term early. Residential Tenancy Act, ss. 44, 45
  • Alberta: A fixed-term tenancy ends on its end date without notice. A tenant ends a monthly tenancy with notice served on or before the first day of a tenancy month, ending on its last day. Residential Tenancies Act, ss. 8, 15
  • Québec and other provinces: Rules differ. Check your province’s residential tenancy law.

United Kingdom · checked

Australia · checked

  • New South Wales: Leaving a fixed term of 3 years or less early can cost a set break fee: 4 weeks’ rent in the first quarter of the term, then 3, 2 or 1 week. Ending a periodic agreement takes at least 21 days’ notice. Residential Tenancies Act 2010, ss. 97, 107
  • Victoria: A renter’s notice of intention to vacate must give at least 28 days. Residential Tenancies Act 1997, s. 91Z
  • Queensland: A tenant’s notice of intention to leave without a ground gives at least 14 days and not before the end of a fixed term, on the approved form. RTRA Act 2008, ss. 308, 327, Sch. 1
  • Other states and territories: Rules differ. Check your state or territory’s tenancy authority.

Before you send it

  • Read your lease first: it may say how much notice to give, how to deliver it and whether early termination is allowed for a fee.
  • A landlord’s notice ending a tenancy must follow the law where the rental is: the notice period, how it is delivered and, in some places, a reason. In California, a landlord’s notice must include the abandoned-property sentence; tick the box to add it.
  • Send it in a way you can prove: by hand with a witness, by certified mail, or by email if the lease allows it, and keep a copy.
  • Agree in writing: if the other side agrees to end the lease early, use the agreement and have both sign it.

Frequently asked questions

Is this lease termination letter generator free?

Yes. It is free to use, needs no account or sign-up, and never adds a watermark or a SnapPaperwork logo to your letter.

Can a tenant end a lease early?

Only as the lease, an agreement with the landlord or the law allows. You can ask with the request letter, and if the landlord agrees, both sign the early termination agreement.

How does a servicemember end a lease?

With written notice to the landlord and a copy of the military orders, under the Servicemembers Civil Relief Act. Choose “Tenant: military orders (SCRA)”; the guide on this page explains when the lease ends.

Can I change the wording?

Yes. Click any text on the letter to rewrite it, or use the Wording panel. Choosing another kind of letter starts again with that kind’s wording.

Does a tenant sign the early termination agreement?

Yes. You sign on the pad (or in ink), and the tenant signs and dates the printed copy beside your signature. Each keeps a copy.
